These Terms and Conditions govern all orders placed with Martial Art Textile Supplies® ("we", "us", "our"). By submitting an enquiry or placing an order you confirm you have read and agree to these terms. These terms comply with the Consumer Rights Act 2015, Sale of Goods Act 1979, Supply of Goods and Services Act 1982, and the Consumer Contracts Regulations 2013 where applicable. These terms govern B2B commercial transactions.
1. Definitions
Supplier: Martial Art Textile Supplies®, the company providing printing and event branding products and services.
Customer / Client: The business or individual placing an order with the Supplier.
Order: A confirmed request for goods or services submitted in writing or via electronic communication.
2. Scope of Application
These Terms apply to all orders placed with Martial Art Textile Supplies®. Where a separate written contract exists between the parties, these Terms apply to any matters not covered by that contract.
3. Placing and Confirming an Order
Orders must be submitted via the enquiry form on this website, by email, or via another format agreed in writing by both parties. Verbal or telephone-only arrangements are not binding.
An order is confirmed only when the Customer receives a written Order Confirmation from us specifying: product, material, size, quantity, price, turnaround time, and estimated dispatch/delivery date. The Customer must review the confirmation and raise any issues promptly. Failure to raise issues shall be deemed acceptance of the confirmation terms.
Once an order has been confirmed and production has commenced, cancellation by the Customer will incur a charge of 100% of the gross order value plus any disposal costs. Any amendments to a confirmed order requested by the Customer will be charged accordingly, including any production downtime costs.
4. Artwork and Print Files
The Customer is responsible for supplying print-ready artwork files. Files should be submitted as print-ready PDF (PDF 1.3 or 1.6, Trim Box format), TIFF (flattened, LZW compression, 8-bit CMYK), or EPS/Photoshop (no preview, maximum quality JPEG). All files must be prepared in CMYK colour mode using the Fogra39 colour profile.
Files should be scaled 1:1 or 1:10. Minimum DPI values vary by print size — please request our full specification sheet. All fonts must be embedded or converted to curves. Safety margins of 2–10cm (depending on print size) must be observed for all key design elements.
We reserve the right to make minor file corrections (e.g. adjusting text away from cut lines) where necessary to make a file printable. We will inform the Customer of any significant issues. The Customer bears sole responsibility for errors in supplied artwork. Failure to supply compliant files may result in additional charges.
Supplied graphic files will be archived for 7 days after order completion, after which they may be deleted.
5. Intellectual Property & Copyright
The Customer warrants that all artwork, logos, and materials supplied do not infringe the intellectual property rights of any third party. The Customer indemnifies Martial Art Textile Supplies® against any third-party claims arising from the use of supplied materials.
The Customer agrees that finished products may be used by Martial Art Textile Supplies® for the purpose of portfolio, marketing, and demonstration of technical capability, unless the Customer notifies us in writing that they object to this.
Any design files or artwork created by us on behalf of the Customer remain our intellectual property until full payment is received.
6. Turnaround, Dispatch & Delivery
Production timescales commence from the point at which a complete and confirmed order is received, including payment (where required in advance) and approved print-ready artwork.
Estimated delivery dates are indicative. We are not liable for delays caused by circumstances beyond our reasonable control, including but not limited to: severe weather, carrier delays, strikes, civil unrest, or force majeure events. We will notify the Customer promptly of any such circumstances.
All orders are dispatched via UPS standard and prices include standard shipping. The Customer must verify delivery upon receipt: checking the number of packages against the delivery note, the condition of packaging, and the completeness of documentation. Any damage or discrepancy must be noted on the delivery record in the presence of the carrier's representative at the time of delivery.
We are not liable for delays, damage, or loss caused by the carrier once goods have been dispatched. In the event of carrier-caused damage or loss, any claim must be raised directly with the carrier and supported by a signed delivery damage report.
7. Pricing & Payment
All prices are quoted in GBP (or converted equivalent) and are exclusive of VAT unless stated otherwise. Prices include standard UPS shipping within agreed territories. The confirmed price is binding from the point of order confirmation.
Payment is required in advance unless a separate credit arrangement has been agreed in writing. We reserve the right to withhold dispatch of goods where payment has not been received in full.
Prices displayed on this website are indicative and subject to confirmation at the point of order based on final specifications. We reserve the right to update prices on this website at any time.
8. Colour Accuracy
Colour reproduction is subject to the nature of large-format digital print. Minor deviations from screen-viewed or digitally-proofed colour are inherent to the print process and do not constitute a defect. Colour-critical orders should specify a physical colour reference (e.g. CMYK values or Pantone reference). Complaints about colour will only be considered where output demonstrably deviates from an agreed approved physical proof. Screen-viewed colour is not an accepted basis for a colour complaint.
Colours will generally be more vivid on PVC substrates than on fabric/textile prints due to material absorbency — this is a known characteristic of the materials, not a defect.
9. Complaints, Defects & Warranty
Any complaint must be raised in writing within 7 working days of delivery. We will acknowledge your complaint within 2 working days and aim to resolve it within 5 working days, or 14 working days for complex matters.
Complaints will only be considered in respect of inconsistencies between the delivered product and the confirmed order specification. The Customer must retain the questioned product and make it available for inspection if requested.
The following are not accepted as grounds for complaint:
- Minor colour deviations where no agreed physical proof was provided
- Dimensional tolerances within the standard production tolerance table (available on request)
- Damage caused by improper installation, misuse, or environmental exposure after delivery
- Damage caused by the Customer or their agents during installation or use
- Carrier damage where no delivery damage report was completed and signed at the time of delivery
- Products that have been used — use of the product constitutes acceptance of its condition
- Colour variations between orders placed at different times
- Errors in artwork supplied by the Customer
- Files submitted in RGB or non-CMYK format
Where a complaint is upheld, our liability is limited to: re-printing and redelivering the affected product, or issuing a partial or full credit against the order value. We do not accept liability for consequential losses, loss of revenue, or event-related losses.
Guarantee periods vary by material type. A full guarantee schedule is available on request.
10. Limitation of Liability
Our total liability to the Customer in respect of any order is limited to the value of that individual order. We exclude all liability for indirect or consequential losses, including but not limited to: loss of profit, loss of event revenue, reputational damage, or costs arising from event cancellation or postponement.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
11. Governing Law & Jurisdiction
These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
In the event of a dispute, both parties agree to attempt to resolve the matter in good faith before initiating formal legal proceedings.
12. Changes to These Terms
Martial Art Textile Supplies® reserves the right to update these Terms at any time. Orders placed prior to any amendment will be governed by the Terms in force at the date of that order. The current version of these Terms is always available on this website.
